Statute Review: 625 ILCS 5/6-206 Discretionary Suspension/Revocation of License or Permit

625 ILCS 5/6-206 gives the secretary of state the discretion to suspend or revoke a person's driving privileges without a hearing for violation of certain offenses. The Secretary of State almost always uses this discretion to suspend or revoke driving privileges. This statute references other statutes by number instead of offense title, forcing the reader to do additional research. 625 ILCS 5/6-206 is interpreted below by name or title instead of citation only.

625 ILCS 5/6-206(a)(1)

Any offense which mandatory revocation of a driver's license is required upon a conviction (all offenses listed in 625 ICLS 5/6-205)

625 ILCS 5/6-206(a)(2)

Conviction of three (3) moving violations within any twelve (12) month period

625 ILCS 5/6-206(a)(3)

The driver has been repeatedly involved in motor vehicle collisions or repeatedly convicted of moving violations that indicate a lack of ability to exercise ordinary and reasonable care of a motor vehicle.

Has refused to submit to a drug or alcohol test in any motor vehicle or boating accident that resulted in personal injury or death as required by 625 ILCS 5/11-501.6, driver involvement in a personal injury or fatal motor vehicle accident; chemical test, or 625 ILCS 45/5-16c, operator involvement in personal injury or fatal boating accident; chemical tests. Additionally, if the test submitted resulted in an alcohol concentration of .08 or more or any amount of drug or compound from the unlawful use of cannabis, a controlled substance, or methamphetamine, the penalty shall be prescribed by 625 ILCS 5/6-208.1

Has been convicted of aggravated discharge of a firearm in violation of 720 ILCS 5/24-1.2 if the offender was located in a motor vehicle at the time the firearm was discharged
